Автор приходит к выводу о том, что они (правовые процедуры) являются одним из множества механизмов, с помощью которых можно регулировать взаимодействие государства с частными лицами. В связи с тем, что область исследования чрезвычайно широка, в работе проанализированы только отдельные виды взаимодействий и выявлены их особенности между правительством и гражданами, которые могут быть потенциально подавляющими: отношения регулирующих органов к бизнес-структурам; отношение финансирующих органов к получателям государственных грантов; отношение органов поддержания порядка к гражданам; отношение государственных органов к частным лицам. Научная новизна: в ч. I данной статьи обсуждаются источники бюрократического давления и выделяются четыре таких источника: различия в статусе, отношения с незнакомыми людьми, институциональные отклонения и дивергентные стимулы. В ч. II рассматриваются четыре решения проблем бюрократического давления, предложенные автором и частично применявшиеся на практике. Первые два из них - судебное решение о надлежащих правовых процедурах и законодательное решение об омбудсменах - затрагивают действующих лиц вне административной системы. Вторые два - решение теории управления об администрировании, ориентированном на клиента, и микроэкономическое решение о рыночных стимулирующих механизмах - являются внутренними для этой системы. Ввиду ограниченности этих решений в ч. III предложено еще одно решение, получившее название «коллективный наблюдатель». Таким наблюдателем мог бы стать специальный орган законодательной системы, привлекающий внимание административного органа к случаям давления, а затем работающий совместно с данным административным органом с целью ликвидации проблемы или улучшения ситуации.Практическая значимость: основные положения и выводы статьи могут быть использованы в научной, педагогической, правотворческой и правоприменительной деятельности.</p></abstract><trans-abstract xml:lang="en"><p>Objective: to consider and study the legal procedures aimed at deterring bureaucratic oppression.Methods: dialectic approach to cognition of social phenomena, enabling to analyze them in historical development and functioning in the context of the totality of objective and subjective factors that determined the choice of the following research methods: analysis, synthesis, comparison, systematic, formal-legal, comparative-legal methods.Results: the auricle views legal procedures aimed at deterring bureaucratic oppression. The author comes to the conclusion that these legal procedures are one of the multiple mechanisms which allow regulation of interaction between a state and private persons. As the problem extends to an extremely broad range of interactions, the paper analyzes and reveals the features of only certain types of potentially oppressing interactions between a state and citizens: the treatment of business enterprises by regulatory agencies; the treatment of government grantees by funding agencies; the treatment of individuals by protective services; and the treatment of individuals in government institutions.Scientific novelty: Part I of the Article discusses the sources of bureaucratic oppression and identifies four such sources: status differences, stranger relations, institutional pathologies, and divergent incentives. Part II explores four solutions to the problem of bureaucratic oppression that have been proposed and in some cases implemented. The first two - the judicial solution of due process and the legislative solution of ombudspersons - involve actors external to the administrative system. The second two - the management theory solution of client-centered administration and the microeconomic solution of market simulating mechanisms - are internal to that system. Because of the limitations of these various solutions, Part III proposes an additional solution, described as a collaborative monitor.
