Автор рассматривает существующие и предлагаемые подходы к регулированию, а также то, как государственные и частные субъекты ограничивают использование синтетических медиа в контексте существующей судебной практики и требований Первой поправки. Хотя первоначальные запреты сыграли необходимую роль, автор считает, что наилучшим подходом будет обеспечение прозрачности, а развивать его следует путем создания базы данных о синтетических материалах в рекламе.</p></sec><sec><title>Научная новизна</title><p>Научная новизна: в последнее время в политической рекламе все чаще используют синтетические медиа, т. е. контент, созданный с использованием искусственного интеллекта. Соответствующие правовые нормы были быстро внедрены штатами в США и онлайн-платформами, тогда как федеральное законодательство по большей части все еще проходит обсуждение в комитетах. Синтетические медиа могут оказывать негативное влияние в результате манипулирования избирателями и искажения принципов демократии; однако они также снижают затраты на предвыборную кампанию и помогают более наглядно проиллюстрировать последствия политического выбора. Ряд государств и отдельных комментаторов выступают за запрет наиболее вредоносных форм синтетических медиа, тогда как другие считают необходимым применять более прозрачные подходы к их регулированию. Каждый следующий избирательный цикл поднимает вопрос о том, как сделать так, чтобы граждане делали выбор на основе убеждений, а не манипуляций.</p></sec><sec><title>Практическая значимость</title><p>Практическая значимость: основные положения и выводы статьи могут быть использованы в научной, педагогической и правоприменительной деятельности при рассмотрении вопросов, связанных с законодательством о выборах в США.</p></sec></abstract><trans-abstract xml:lang="en"><sec><title>Objective</title><p>Objective: to analyze the benefits and drawbacks of legal regulation of relations in the sphere of the US elections in the context of using artificial intelligence.</p></sec><sec><title>Methods</title><p>Methods: the article employs the dialectical method of cognition, as well as general scientific (analysis, synthesis, induction, deduction) and specific scientific (formal-legal) research methods.</p></sec><sec><title>Results</title><p>Results: The article assesses the current regulatory landscape for synthetic media in political advertising to analyze the benefits and drawbacks of greater regulation. Based on current and emerging regulatory approaches, the author examines how governments and private actors have limited synthetic media usage within existing First Amendment jurisprudence. Although initial prohibitions served a necessary role, the author proposes that transparency enforcement is the best approach and should be built upon by creating a repository that contains information on an advertisement's synthetic content.</p></sec><sec><title>Scientific novelty</title><p>Scientific novelty: Synthetic media, or content generated using artificial intelligence, has begun to infect political advertising. Federal legislation has spent most of its time stalled in committees, but states and online platforms have rapidly implemented regulations. Although synthetic media may pose harms through voter manipulation and democratic distortion, it also can lower campaign costs and more vividly illustrate conceptions of a political choice's consequences. Some governments and commentators have sought to prohibit the most harmful forms, while others have focused more on transparent approaches to regulation. In the face of yet another contentious election cycle, the question of how to ensure choices are made based on belief and not manipulation looms large.</p></sec><sec><title>Practical significance</title><p>Practical significance: the main provisions and conclusions of the article can be used in scientific, pedagogical and law enforcement activities when considering the issues related to regulation of the US elections.</p></sec></trans-abstract><kwd-group xml:lang="ru"><kwd>синтетические медиа</kwd><kwd>предвыборные выступления</kwd><kwd>политическая реклама</kwd><kwd>искусственный интеллект</kwd></kwd-group><kwd-group xml:lang="en"><kwd>synthetic media</kwd><kwd>election speeches</kwd><kwd>political advertising</kwd><kwd>artificial intelligence</kwd></kwd-group><funding-group><funding-statement xml:lang="ru">Автор выражает искреннюю благодарность профессору Оливеру Силвейну за руководство и помощь в процессе написания работы.
