Timiryasov; Mari State University</institution><country>Russian Federation</country></aff></aff-alternatives><pub-date pub-type="collection"><year>2026</year></pub-date><pub-date pub-type="epub"><day>19</day><month>03</month><year>2026</year></pub-date><volume>20</volume><issue>1</issue><fpage>174</fpage><lpage>189</lpage><permissions><copyright-statement>Copyright &amp;#x00A9; Томашевский К.Л., 2026</copyright-statement><copyright-year>2026</copyright-year><copyright-holder xml:lang="ru">Томашевский К.Л.</copyright-holder><copyright-holder xml:lang="en">Tomashevski K.L.</copyright-holder><license xml:lang="ru" license-type="creative-commons-attribution" xlink:href="https://creativecommons.org/licenses/by/4.0/" xlink:type="simple"><license-p>Данная работа распространяется под лицензией Creative Commons Attribution 4.0.</license-p></license><license xml:lang="en" license-type="creative-commons-attribution" xlink:href="https://creativecommons.org/licenses/by/4.0/" xlink:type="simple"><license-p>This work is licensed under a Creative Commons Attribution 4.0 License.</license-p></license></permissions><self-uri xlink:href="https://www.rusjel.ru/jour/article/view/2756">https://www.rusjel.ru/jour/article/view/2756</self-uri><abstract><sec><title>Цель</title><p>Цель: выявление законодательных подходов, которые могут представлять интерес для возможного учета или заимствования при построении сервисного государства в России, на основе сравнительно-правового анализа зарубежного опыта регулирования коллективных трудовых прав гиг-занятых в цифровой экономике ряда зарубежных государств (Австралии, Новой Зеландии, некоторых стран Азии).</p></sec><sec><title>Методы</title><p>Методы: диалектический, а также комплекс общенаучных методов (системного анализа, синтеза, классификации, обобщения, индукция, дедукция), специальных научных методов (конкретно исторический, формально юридический, сравнительно-правовой).</p></sec><sec><title>Результаты</title><p>Результаты: выявлены сходства и различия в правопорядках Австралии, Новой Зеландии и ряда стран Азии (Малайзии, Республики Корея, Японии и др.) в регламентации коллективных трудовых отношений, что позволило обосновать некоторые предложения об урегулировании коллективных трудовых прав гиг-занятых в трудовом законодательстве России с учетом изученного зарубежного опыта, а именно в расширении сферы действия Федерального закона от 12 января 1996 г. № 10-ФЗ «О профессиональных союзах, их правах и гарантиях деятельности» за счет охвата им профсоюзного членства гиг-занятых (по аналогии с подходами, выработанными в законодательстве и практике Индонезии и Японии). Кроме того, автором высказаны предложения о целесообразности последующей корректировки ст. 29–34, 36, 40, 45 Трудового кодекса Российской Федерации в отношении понятий участников коллективных переговоров, сторон коллективных договоров соглашений, представителей работников и работодателей.</p></sec><sec><title>Научная новизна</title><p>Научная новизна: впервые в науке трудового права высказана концептуальная идея о частичном расширении сферы действия трудового права за счет урегулирования коллективных трудовых прав гиг-занятых с наделением их правом вступать в профсоюзы, вести коллективные переговоры, а в перспективе и заключать коллективные договоры с операторами или партнерами цифровых трудовых платформ.</p></sec><sec><title>Практическая значимость</title><p>Практическая значимость: выражается в том, что сформулированы некоторые предложения, которые могут быть учтены российским законодателем при совершенствовании норм Федерального закона «О профессиональных союзах, их правах и гарантиях деятельности», Трудового кодекса Российской Федерации и других законов в части расширения коллективных трудовых прав гиг-занятых.</p></sec></abstract><trans-abstract xml:lang="en"><sec><title>Objective</title><p>Objective: to analyze foreign legislation on the collective labor rights of gig workers (Australia, New Zealand, and some Asian countries) and its reception in Russian legislation.</p></sec><sec><title>Methods</title><p>Methods: dialectical method; a complex of general (system analysis, synthesis, classification, generalization, induction, deduction) and special (specific historical, formal legal, comparative legal) scientific methods of cognition.</p></sec><sec><title>Results</title><p>Results: the author studied foreign experience of the legal regulation of collective labor relations in Australia, New Zealand, Malaysia, Indonesia, the Republic of Korea, Japan and other countries and substantiated proposals on settling collective labor rights of gig workers in the labor legislation of Russia. These include the following: expanding the area of legal regulation in the Federal Law of January 12, 1996, No. 10-FZ “On trade unions, their rights and performance guarantees” in terms of extending its effect to trade union memberships of gig workers (by analogy with the approaches developed in the legislation and practice of Indonesia and Japan); improving the conceptual framework of the Russian labor legislation (participant in collective bargaining, parties to a collective agreement, representatives employees and employers, etc.).</p></sec><sec><title>Scientific novelty</title><p>Scientific novelty: for the first time in the science of labor law, a conceptual idea was expressed to expand the scope of Russian labor law in terms of regulating the collective labor rights of gig workers and to endow them with the right to join trade unions, conduct collective bargaining, and eventually conclude collective agreements with operators or partners of digital labor platforms.</p></sec><sec><title>Practical significance</title><p>Practical significance: the formulated proposals are aimed at improving the Russian Labor Code, the Federal Law “On trade unions, their rights and performance guarantees”, and other regulatory legal acts regarding the expansion of collective labor rights of gig workers.</p></sec></trans-abstract><kwd-group xml:lang="ru"><kwd>трудовое право</kwd><kwd>трудовое законодательство</kwd><kwd>гиг-занятые</kwd><kwd>коллективные трудовые права</kwd><kwd>коллективные переговоры</kwd><kwd>профсоюзы</kwd><kwd>работодатели</kwd><kwd>коллективные договоры</kwd><kwd>соглашения</kwd></kwd-group><kwd-group xml:lang="en"><kwd>labor law</kwd><kwd>labor legislation</kwd><kwd>gig workers</kwd><kwd>collective labor rights</kwd><kwd>collective bargaining</kwd><kwd>trade unions</kwd><kwd>employers</kwd><kwd>collective agreements</kwd><kwd>treaties</kwd></kwd-group><funding-group><funding-statement xml:lang="ru">Исследование выполнено за счет гранта Российского научного фонда № 25-28-01387, https://rscf.ru/project/25-28-01387/</funding-statement><funding-statement xml:lang="en">The research was carried out under the grant of the Russian Scientific Fund No. 25-28-01387, https://rscf.ru/project/25-28-01387/</funding-statement></funding-group></article-meta></front><back><ref-list><title>References</title><ref id="cit1"><label>1</label><citation-alternatives><mixed-citation xml:lang="ru">Зайцева, О.
