THE TREATY REGIME OF THE SPOUSES' PROPERTY: SOME FAMILY-LAW AND CIVIL-LAW ASPECTS
Abstract
The article raises the issues connected with the notion of treaty of marriage, its content, procedure and conditions of celebration, changing and termination. It analyzes the balance between civil-legal and family-legal regulation of the spouses' privities. It investigates and offers a new understanding of the essence of such treaty of marriage. It also proposes to apply the treaty regime of the spouses' relations regulation for some non-pecuniary relations between them.
