ON CORRELATION BETWEEN NATIONAL AND EUROPEAN LAW
Abstract
Dozens of years of discussions and battles - constitutional or international law? Correlation. Priority. European Community - the pilot project, it seemed to set the priority of the national law over the international one… Soon the constitutions will be ruined under international treaties ad principles. It seems that this priority should just be legitimated. But no, the constitutional courts of the main European states defended their constitutions. At the head of the battle is the FRG Constitutional court. How it happened and who won - this is what the article is about.
